Attorney Bob Schwartz
Bob Schwartz Leads Session on Seven Elements of Just Cause
Labor Attorney Bob Schwartz recently presented a training on "Seven Elements of Just Cause" for labor staff, leaders and rank and file members in the Merrimack Valley and North Shore regions. With plans to write a book on the topic to help union leaders and staff win dismissal and discipline cases, Bob has been researching the subject for close to a year. Participants from unions in the private and public sectors learned how to prepare and present a discharge grievance, focusing on the seven tests of just cause developed by arbitrator Carroll Daugherty. Bob discussed employee defenses such as lack of notice, failure to investigate, Jispaiale_Jieatment, mitigating circumstances, and progressive discipline. He explained how to construct a thorough request for information and present other techniques that will strengthen the union's case. Participants left the session with many questions answered and with more confidence to defend their members against discipline and dismissals.
